Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of the website australiagolfcarts.com and any purchase of goods or services from Australia Golf Carts ([REPLACE: legal entity name Pty Ltd], [REPLACE: ABN 00 000 000 000]) (“we”, “us”, “our”). By using the site or placing an order, you agree to these Terms.
1. About us
Australia Golf Carts supplies new and pre-owned golf carts, utility vehicles, parts, accessories, servicing and short-term rentals throughout Australia. Our registered office is at [REPLACE: street address, Suburb, NSW POSTCODE].
2. Eligibility
To place an order you must be at least 18 years of age, an Australian resident or business, and able to enter into a legally binding contract. We do not accept orders for delivery outside Australia.
3. Pricing
All prices on the site are in Australian Dollars (AUD) and include GST unless otherwise stated. Prices are subject to change without notice. Shipping and freight insurance are calculated at checkout based on delivery destination and product weight.
4. Orders and acceptance
When you place an order through our website, you are making an offer to purchase. We may accept or reject your offer at our discretion. A contract is formed only when we send you a confirmation email accepting your order. We may reject an order where:
- The product is no longer available;
- There has been a pricing or product description error on our site;
- We cannot verify your identity or payment;
- We suspect fraud or that the order is for resale without our consent.
5. Custom builds and deposits
Carts ordered with custom configurations (colour, drivetrain, upholstery, accessories or other build-to-order options) require a non-refundable deposit of 25% of the final invoice at the time of order. The balance is due before dispatch. Custom builds typically take 4–6 weeks before freight commences. Custom-built carts are not eligible for change-of-mind returns; see our Refund & Returns Policy.
6. Payment
We accept payment by credit card (Visa, Mastercard, American Express), PayPal, Afterpay (where eligible), and bank transfer for orders above A$10,000 on prior arrangement. All card transactions are processed by our PCI-DSS compliant payment providers. You authorise us to charge the payment method you provide at checkout.
7. Delivery, title and risk
Delivery is governed by our Shipping Policy. Title in the goods passes to you on receipt of payment in full. Risk in the goods passes to you on delivery to the address you specify. You are responsible for ensuring access for tail-lift truck delivery and for inspecting the goods on receipt.
8. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth), “ACL”). For major failures, you are entitled to a refund, replacement, or compensation for any other reasonably foreseeable loss or damage. For minor failures, you are entitled to have the goods repaired or replaced. Nothing in these Terms excludes or limits any right you have under the ACL.
9. Warranty
Our standard warranty terms are set out on our Warranty & Servicing page. The manufacturer’s warranty applies in addition to your rights under the ACL.
10. Trade-in and finance
Trade-in valuations are indicative only and subject to physical inspection. Final trade-in value is at our discretion. Finance applications are processed through our independent finance partners; we do not provide credit ourselves. Approval is subject to the lender’s assessment.
11. Intellectual property
The website, including all text, images, logos, video and code, is owned by or licensed to Australia Golf Carts. You may not copy, modify, distribute or republish any of our content without our written permission, except for normal browsing and to keep a personal record of your order. All trade marks shown on the site are the property of their respective owners.
12. User conduct
You agree not to use the site to:
- Engage in fraudulent or illegal activity;
- Attempt to gain unauthorised access to our systems;
- Send automated traffic, scrape content at scale, or interfere with normal site operation;
- Submit content that is unlawful, defamatory or infringing.
13. Limitation of liability
To the maximum extent permitted by law, and subject to your non-excludable rights under the ACL, our liability for any defect, error or breach is limited at our option to the replacement or repair of the goods, the resupply of the services, or the refund of the price paid. We are not liable for any indirect or consequential loss including loss of profit, opportunity or business interruption.
14. Force majeure
We are not liable for any failure or delay caused by events outside our reasonable control, including natural disasters, strikes, transport disruption, supplier failure, pandemic, or government action.
15. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and Australia.
16. Changes
We may update these Terms from time to time. The current version is always available on this page. Material changes will be communicated by email or a notice on our website. Orders placed before a change are governed by the Terms in effect at the time of order.
